MEDIATION...
IT WORKS!

One
of the most underutilized benefits of being a CIBS member
is the availability of inexpensive alternative dispute
resolution. CIBS offers mediation and arbitration services
to its members for a nominal fee. Most recently a dispute
between two members was successfully mediated. After
an initial complaint was lodged, the mediation process
began by requesting the two brokers who were involved
in the dispute to submit their versions of the facts
in writing to the Ethics and Arbitration Committees
of CIBS. The Committee Chairs, along with CIBS attorney,
Lawrence Feldman, reviewed the information. By prior
agreement, and according to the rules set down in our
bylaws, Ray Finklestein, Larry Feldman and I then met
with both parties. The setting was informal and neither
party was represented by counsel. Through discussion,
a compromise was reached to which both parties agreed.
The dispute was thus settled.
We
are pleased to report that although we do not need to
mediate or arbitrate disputes very often, it is one
of the ways in which CIBS is able to serve the brokerage
community. By utilizing the available alternative dispute
resolution forums that CIBS offers, a significant amount
of time and money was saved by the brokers involved
and a fair and equitable solution was reached. Win -
win. |
CIBS
2nd ANNUAL FOOD & CLOTHING DRIVE to TAKE PLACE JAN
24th
We
are presently working on our 2nd Annual Food and Clothing
Drive, the proceeds of which will be donated to Island
Harvest. Our first food and clothing drive, held last
year was a huge success. Bags of food and armloads of
clothing were brought by members to the location where
the CIBS seminar was held. The Island Harvest truck
with two volunteer workers picked up the goods later
that morning.
Plan
to participate in this very meaningful activity scheduled
to take place this year on January 24th. (Refer to the
calendar in this
newsletter for additional details.) Please bring canned
or boxed food goods and clean clothing suitable for
children, women or men into the building with you.

MOST
INGENIOUS DEAL of the YEAR AWARD
Most
members are aware that the Annual CIBS/ABLI Dinner includes presentations
for Lifetime Achievement, Most Ingenious Broker Deal of the Year,
and Developer of the Year Awards. The selection process and the judgment
criteria for the Most Ingenious Deal are as follows:
To be selected by the Chairman, President, and Vice Chairman of ABLI
(the Selection Committee).
The submitter must be a Regular Member in good standing of CIBS for
both the calendar year of submission and the calendar year in which
the transaction occurred.
All submissions to be forwarded no later than March 1st to the President
of CIBS who in turn forwards to the Executive Director of ABLI for
screening for compliance with the rules who will then forward to the
ABLI Selections Committee. Any submission which does not comply with
the rules will be automatically disqualified.
Submissions must have involved a Long Island real estate property(ies)
or developmental site(s) and, in order to qualify for this award,
the transaction must have been completed during the calendar year
2001.
Submissions must give full credit to all qualified cooperating brokers
and salespersons, be endorsed by the broker/management employer and
be prepared by the contestants without professional assistance.
The text of submissions must be no longer than ten 8 ½ x 11
pages, double-spaced, including maps, diagrams and photographs; six
(6) copies of submissions are required.
The format should include a description of the transaction with an
explanation of why the submitter considers the transaction ingenious
in its conception. It should also include a step by step process outlining
initial involvement to the conclusion of the transaction.
